Railroad Retirement Board Amends Annuity Regulations to Address Sex-Based Disparity

WASHINGTON, Sept. 12 (TNSFR) -- The Railroad Retirement Board is amending its regulations to remove provisions that provided unequal treatment for male and female spouses. The regulations, which define when a spouse, divorced spouse, surviving divorced spouse, or remarried widow or widower of a railroad employee may receive an annuity, contained a disparity that could violate the right to equal protection under the Due Process Clause of the Fifth Amendment to the U.S. Constitution.
