WASHINGTON, Sept. 19 -- The U.S. Department of Energy's Federal Energy Regulatory Commission issued the following statement by Commissioner Richard Glick on a decision (Docket No. P-14858-000) involving McMahan Hydroelectric:
"I concur in part and dissent in part from today's order. Although I agree that the North Carolina Department of Environmental Quality (North Carolina DEQ) waived its authority under section 401 of the Clean Water Act,1 I disagree with important of aspects . . .
